I have just wrote a blog post about this but basically using AdWords dynamic keyword insertion (http://blog.seoptimise.com/2006/09/adwords-dynamic-keyword-insertion.html) currently allows you to use trademark terms in your ad text which should be blocked.

It is a loop hole in the adwords system. Only an editor would catch this. The editor at google would have to be very detailed in reviewing every and all adwords accounts that cross their desk.

It requires one to scan keywords lists very carefully. I only bid on what I consider very general terms... And still...
